Purpose
The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning outside counsel services for lawsuit concerning Southeast Interceptor Failure.
Background
It is recommended that the law firm of Bass, Berry, & Sims, PLC provide legal representation on behalf of the City of Franklin concerning the Southeast Interceptor failure. The terms of representation have been outlined and Bass, Berry, & Sims, PLC is in receipt of the City’s Law Department Policy and Procedures for Outside Counsel. The Law Department has requested that Attorney L. Wearen Hughes and his staff take precautionary measures to become familiar with the terms of the Policy.
Financial Impact
The current rates/hour for municipal work are as follows:
• Attorneys $425.00
• Associates $325.00 (John Dawson’s current rate as partner/member is $345/hour)
• Paralegals $195.00

Staff recommends that the Board of Mayor and Aldermen acknowledge receipt of this report of execution for Contract No. 2017-0190, to retain Attorney L. Wearen Hughes and his firm, Bass, Berry, & Sims, PLC for outside counsel services.
