Purpose

The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning COF Contract No. 2020-0020 Settlement Agreement And Final Release Of Claims, in which the City confirms that a minor sidewalk repair made on Werthan Circle met the City’s satisfaction and which authorizes the insurance company to make payment of $4,000 to the vendor for the repair.

 

Background

On September 10, 2019, Signs, Inc. caused damage to the sidewalk at 108 Werthan Circle while installing a sign for Metro Self Storage.  The City required the sidewalk to be repaired, and Signs, Inc. hired M.A.Y. Construction to do the work.  Tri-State Insurance of Minnesota is Signs, Inc.’s insurance carrier.  Tri-State Insurance requires a release be signed stating that the work was satisfactory to close out the claim for payment to M.A.Y. Construction.  City staff inspected the repaired sidewalk as part of a Right-Of-Way inspection and was satisfied that the repair work was completed to City specifications.

 

Financial Impact

There is no financial impact to the City.

 

Recommendation

Staff recommends approval of COF Contract No. 2020-0020.
