Purpose
The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning stormwater control measures maintenance program.
Background
The Engineering Departments Stormwater Division helps the City maintain compliance with mandates set by the Environmental Protection Agency (EPA) and Tennessee Department of Environment and Conservation (TDEC) governments to minimize stormwater runoff pollution. Under the Clean Water Act of 1972, the EPA requires municipalities like Franklin to manage stormwater. The City has received a Phase II Municipal Separate Storm Sewer System (MS4) Permit from TDEC to allow Franklin to discharge stormwater into nearby rivers and streams.
Part of our permit requires the City of Franklin to implement a permanent stormwater management program focused on removing pollutants from stormwater discharges through management practices, control techniques and system, design and engineering methods implemented to the maximum extent practicable (Green Infrastructure). This program must consist of plan review, site inspection and a means to ensure permanent stormwater control measures are adequately maintained. To implement this requirement, we require all new developments to design and construct private stormwater control measures (green infrastructure, riparian buffers, detention facilities, etc.) and record a long-term maintenance agreement at the Williamson County Registers of Deeds office. These maintenance agreements requires the private property owner to inspect and maintain the permeant stormwater control measures at least once every year. The City of Franklin is then required/responsible for ensuring compliance with the recorded long-term maintenance agreements. This includes obtaining annual inspection reports from the private property owners and conducting an inspection of the facility once every five years to ensure that maintenance is being completed and the facilities continue to remove the necessary pollutants from the onsite stormwater. Staff is now in the process of developing and implementing a program to inspect these private stormwater control measures. Prior to implementation, staff wanted to educate the Board of this initiative and obtain feedback back.
