Purpose
The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning the new Mountain Bike Trail System to be constructed by Gateway Mosby Cool Springs, LLC in partnership with the City of Franklin and Columbia State Community College.

Background
Gateway Mosby Cool Springs, LLC (herein "Mosby") is in the process of developing Map 079 -Parcel 04025, consisting of three hundred twenty-eight (328) apartment units, and an affiliate of an indirect owner of Mosby intends to develop or cause the development of approximately twenty-eight (28) townhome lots (herein, "Development Project"). Mosby has agreed to design, construct and maintain a Mountain Bike Trail System located within the outer limits of the development property, and Mosby has agreed to construct, plat and dedicate a non-exclusive, all-access public easement, Mountain Bike Trail System for the future enjoyment of the public.

The Mountain Bike Trail System will partially extend onto land owned by the State of Tennessee on Columbia State Community College Franklin's campus. The Parks Department, on behalf of the City, requests to enter into an agreement with the State of Tennessee for an easement over a portion of the State's property. The easement will allow the City to construct, maintain and operate thereon a pathway for pedestrian or bicycle travel and/or nature trail, including all reasonable ancillary improvements as a part of the Mountain Bike Trail System.
