Purpose

The purpose of this memo is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning the Change Order No. 1 to Construction Contract (COF Contract No. 2017-0198) with Civil Constructors for a Time Extension thru June 3, 2018.

 

Background

The Goose Creek Inn Wastewater Treatment Plant (WWTP) is a small facility that provides wastewater treatment for the Goose Creek Inn, B&G Rentals, and Mapco Family Centers, Inc.  The plant has been in operation since the 1960s and has since deteriorated, no longer capable of providing adequate treatment for discharge into Five Mile Creek.  The Tennessee Department of Environment and Conservation (TDEC) performed a Compliance Evaluation Inspection (CEI) in September 2011 and in December 2015.  These inspections led to a Commissioners Order and Assessment issued by the Tennessee Department of Environment and Conservation Commissioner on September 23, 2016, which required that an aggressive schedule be followed to decommission the WWTP and connect to the City’s sanitary sewer system.  The bid for the gravity sanitary sewer extension project to take the deteriorated and inadequate Goose Creek Inn Wastewater Treatment Plant out of service was awarded to Civil Constructors and work started in February 2018.   The planned length of construction was 90 calendar days with work being completed in May 2018.  There have been significant delays in the sewer crossing of Five Mile Creek which has subsequently caused major delays in the completion of the project.  The City is currently charging liquidated damages to the contractor in the amount of $500 per calendar day that the project is not complete.  This change order is to extend the final acceptance date of the Project to June 3, 2018, which will be the date that liquidated damages begin.
