Purpose

The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) regarding the progress staff has made in drafting a mobile food vendor ordinance and, to request consideration of establishing a grace period for mobile food vendors to operate on private property within the City of Franklin temporarily through December 31, 2018 or until the City of Franklin Board of Mayor and Aldermen have adopted a comprehensive mobile food vending ordinance, whichever occurs first.

Background

A mobile food vendor workgroup comprised of City team members from Law, Parks, Planning, Administration, and Building and Neighborhood Services has commenced meeting bi-weekly to research and develop a mobile food vendor ordinance for the City of Franklin.  During this process, which is anticipated to span several months, staff will facilitate meetings with representatives of the mobile food vendor industry, as well as other restaurateurs, and other groups who have expressed interest in assisting with developing this ordinance.  The proposed Resolution 2018-61 is temporary and provides a grace period for mobile food vendors, who obtain permission from private property owners, to operate through December 31, 2018 or until such time the BOMA have adopted a mobile food vendor ordinance.

Financial Impact

Not applicable at this time.  A fee structure will be evaluated and included as part of the future ordinance for consideration to cover the costs for City staff to permit and monitor mobile food vendors in the City.
