Purpose
The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning legal representation for Condemnation lawsuits needed for right-of-way acquisition associated with the Mack Hatcher Northwest extension project.
Background
It is recommended that the law firm of Miller and Martin, PLLC provide legal representation for Mack Hatcher Condemnation lawsuit on behalf of the City of Franklin. The terms of representation have been outlined and Miller and Martin, PLLC is in receipt of the City’s Law Department Policy and Procedures for Outside Counsel.
Financial Impact
The current market rates for general municipal work are as follows:
• Attorneys $265.00 per hour
• Associates $175.00 per hour
• Paralegals $100.00 per hour

Staff recommends that the Board of Mayor and Aldermen acknowledge receipt of this report of execution for Contract No. 2017-0287, to retain Attorney Douglas Berry and his firm, Miller and Martin, PLLC as legal counsel for Mack Hatcher Condemnation lawsuits.
