Purpose

The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning the Ordinance 2017-22, an Ordinance to Rescind Ordinance 2014-33 and to Adopt a Revised Policy for Public Records Requests.

 

Background

The Board of Mayor and Aldermen adopted the Guidelines for Access to and Reproduction of Public Records and Schedule of Charges for Reproduction of Public Records in 2014. In 2016, the legislature enacted a public chapter requiring local governments to adopt a policy for responding to public records requests. Additionally, the legislature directed a state study committee, along with the Office of Open Records Counsel, to adopt a model policy to ensure uniformity among records policies across the state. Although our current policy meets or exceeds nearly all requirements of the state law, staff has reviewed the model policy and recommends the City adopt it in place of our current one in order to clarify responsibilities and processes in the City.

There will be no financial impact to adopt this ordinance.
