Purpose

The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning a Professional Services Agreement (PSA) with Civil & Environmental Consultants, Inc. (CEC) for the Preliminary Engineering - National Environmental Policy Act (PE-NEPA) phase of the East McEwen Drive Phase 4 Improvements Project.

 

Background

In 2004, the City of Franklin contracted with Sullivan Engineering, Inc. (SEI) to provide the preliminary engineering design of [East] McEwen Drive, between Cool Springs Boulevard/Oxford Glen Drive and Wilson Pike (SR-252.)  Since that time, the City has further contracted with SEI to provide final engineering and construction plans for this project.  Those final plans are nearing completion.

 

As a part of the 2040 Regional Transportation Plan (RTP), developed by the Nashville Area Metropolitan Planning Organization (MPO), the City requested federal funding for the East McEwen Drive Phase 4 Improvements Project. From projects listed in the 2040 RTP, the MPO developed the fiscal year (FY) 2017-2020 Transportation Improvement Program (TIP), which allocates federal transportation dollars to the many MPO member agencies. Included in this recently approved TIP is $10,000,000 in Surface Transportation Block Grant (STBG) funds for the East McEwen Drive project.  While the MPO prioritizes and allocates federal funds to the transportation projects within our region, the administration of funding is ultimately the responsibility of the Tennessee Department of Transportation (TDOT).

 

On March 14, 2017, the BOMA approved the City’s participation in a Local Agency Project Agreement (LAPA) with TDOT, which allows the City to access the federal funds for this project.  The acceptance of state or federal funds obligates the City to follow the latest TDOT procedures, guidelines, manuals, standards, and directives as described in TDOT’s Local Government Guidelines and the LAPA.

 

The first phase in the development of a transportation project is the completion of PE-NEPA.  On March 16, 2017, the City received Letters of Interest (LOI) and Statements of Qualifications (SOQ) from engineering consultants interested in performing the work require to complete PE-NEPA.  After evaluation of the submittals and in-person interviews, staff has selected Civil & Environmental Consultants, Inc. (CEC) as the most appropriate firm to complete this work.  Upon final approval of this PSA (COF Contract No. 2017-0125), CEC will immediately begin work.  City staff and CEC are confident in our abilities to deliver a D-List Categorical Exclusion (D-List CE) within 12 months.  However, it is important to understand that unforeseen issues may arise, which can trigger a more time consuming environmental review process.

 

Financial Impact

On October 25, 2016, the BOMA approved Resolution 2016-69 to adopt the project list for Phase 1 of the fiscal year (FY) 2017-2026 Capital Investment Program (CIP.)  Funding of the East McEwen Drive Phase 4 Improvements Project, through construction, was included in that approved project list.  Funding for this project will be made available through the Capital Projects fund, which is made up of a variety of sources.  The general ledger (GL) code to be utilized for project expenses related to this PSA (COF Contract No. 2017-0125) is 310-89420-43100.

Contingent upon final review by the Law Department, staff recommends approval of the PSA (COF Contract No. 2017-0125) with CEC for the PE-NEPA phase of the East McEwen Drive Phase 4 Improvements Project (TDOT PIN 125418.00) in an amount not-to-exceed $125,017.96.
