Purpose
The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning an irrigation repair agreement (COF Contract No. 2017-0065) with the Founders Pointe Homeowners Association.

Background
The City acquired easements from several property owners along New Highway 96 West (SR-96W) to allow for the construction of a multi-use trail, from Vintage Grove Lane to Vera Valley Drive. Construction of this project caused damage to portions of the irrigation system owned by the Founders Pointe Homeowners Association (HOA). No as-builts of the system were available to perform accurate locates. Therefore, some damage to the system was unavoidable.

During initial meetings with residents of the affected properties, the City agreed to repair any property damage caused by the construction of the multi-use trail. Pristine Properties Landscape and Maintenance, Inc., the landscape and irrigation contractor for the Founders Pointe HOA, provided a proposal, dated February 2, 2017, to repair and replace the damaged portions of the irrigation system at a cost of $30,000.00. This payment would represent the final compensation for any and all damaged to the irrigation system at Founders Pointe that was caused by the City's multi-use trail construction project.

Financial Impact
The cost of this agreement is $30,000.00, which is outside of the original construction budget for this project. It is anticipated that this agreement would be funded through the Capital Projects fund. The general ledger (GL) code to be used for this expe...
