Purpose
The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning Change Order No. 3 to the Construction Contract with Civil Constructors, Inc. for the Hillsboro Road Improvements Project Phase 1, SR96W to Independence Square (COF Contract No. 2012-0110, Resolution 2012-67).
Background
The construction contract for the Hillsboro Road Improvements Project Phase 1, SR-96W to Independence Square, was awarded by the BOMA to Civil Constructors, Inc. on December 11, 2012, for $12,124,758.73. The construction Notice to Proceed stated that the authorized 455 consecutive calendar work days began on February 11, 2013 and ended on May 12, 2014. Change Order No. 1 was approved on July 23, 2013, which included material line item increases. Change Order No. 2 was approved on January 14, 2014 and included a time extension and additional traffic control compensation. That time extension changed the date of completion of all work from May 12, 2014 to July 7, 2014.
This Change Order No. 3 is the final change order and project closeout. Reasons for Change Order No. 3 include:
1. Time extension due to the following issues: Excavation for Wall #2 could not be completed until the AT&T VRAD was relocated. The meeting minutes show Civil needing to start excavation at Wall #2 the 1st week of December 2013, but this excavation could not be completed due to the VRAD relocation until March 13th, 2014. Not only did the relocation of the VRAD delay completion of Wall #2, but in turn delayed completion of underground electrical systems, signalization, sidewalks, curb & gutter and landscaping in this vicinity. Additionally, items of work not originally in the contract were added, including landscaping, curbing, decorative walls, modular block walls, and various electrical items regarding signal controllers and fiber optic lines. Due to the unforeseen delays described herein, the contractor and project team have agreed to extend the number of calendar days allowed to complete this project by a total of 46 days. This time extension changes the date of completion of all work, from July 7, 2014, to August 22, 2014.
2. Final reconciliation of all miscellaneous overruns and underruns of pay items for project closeout.

Financial Impact
Original Contract Price: $12,124,758.73
Current Contract Price: $12,319,944.47 ($12,124,758.73 plus Change Order No. 1 of $184,993.74 and Change Order No. 2 of $10,192.00)
Change Order No. 3 to the construction contract (COF Contract No. 2012-0110) with Civil Constructors, Inc. will be a cost DECREASE of $321,657.24. New contract price becomes $11,998,287.23.
