Purpose

The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning the liability and monitoring associated with when contractors or citizens obstruct or perform work within the public right-of-way.

 

Background

Title 16, Chapter 2 of the Franklin Municipal Code relating to Street Occupancy, Obstructions, and Excavations is being updated to clarify the requirements for contractors and individuals when restricting access to a portion of the street or sidewalk for the period of time during construction, utility maintenance or relocation, dumpster placement, and other activities that temporarily obstruct the public right-of-way.  An example includes the sidewalk obstruction for the 231 Public Square/ First Tennessee Bank building project located adjacent to our City Hall.

 

Financial Impact

The Financial impact is minimal.  The proposed permit fees (separate ordinance) are based on the time period of the obstruction, ensuring period inspection and monitoring by City staff.  A Certificate of Liability Insurance and a minimum Surety/ Bond are required as applicable.
