Purpose
The purpose of this memo is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning approval for an agreement to provide collection support for the Cartwright Creek, LLC water utility district.
 
Background
The City of Franklin (City) has wastewater utility customers that are provided water service by other utility companies; specifically, the HB&TS, Mallory Valley and Milcrofton Utility Districts.  As such, we have entered and maintain service agreements where these Districts will provide assistance in enforcing collections for delinquent City wastewater accounts.  
 
The reciprocal service relationship exists with the Cartwright Creek, LLC, a wastewater utility serving approximately 500 residential and 35 commercial customers in the Grassland area of Williamson County.  For approximately sixty (60) of these customers the City is the water provider which affords Cartwright Creek limited ability to enforce collections.
 
City staff has had discussions with the General Manager of Cartwright Creek, LLC to formalize an agreement which allows for disconnection of water by the City should the customer not meet their payment obligations to the Cartwright Creek.   A proposed agreement, modeled on our other collection support agreements, is included.  
 
Financial Impact
The City has scheduled service fees for disconnections related to non-payment.  At the time of the request for assistance, the Cartwright Creek, LLC will pre pay directly to the City the then scheduled fee for each disconnection.

Staff recommends that the BOMA approve this contract pending final reviews by the City Attorney and the City Administrator.
