Purpose
The purpose of this memo is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning a Facility Encroachment Agreement (2015-0180) with CSX Transportation Inc. (CSXT) This agreement is for the installation of a 36-inch sanitary sewer line crossing as a part of the Spencer Creek at Franklin Road Sanitary Sewer Improvements Project.

Background
The Professional Services Agreement (PSA) for the design of the Spencer Creek at Franklin Road Improvements with Hazen and Sawyer was approved on March 11, 2014. Upon inspection of the section of the 36-inch sanitary sewer along Spencer Creek from the CSXT Railroad tracks, a large blockage was found within the first section of the line.

In order to provide better access and improve the hydraulic capacity of the line the City decided to improve the section of the 36-inch sanitary sewer from Spencer Creek at the CSXT tracks approximately 1,640 feet downstream.

CSX requires their own permit for this installation. This agreement provides the City the right to have a sanitary sewer line encased in the area under the CSXT tracks.

Financial Impact
The following fees were paid from the Sewer General Fund (431-85310-52219): $4,000 for Facility Encroachment, $1,500 for Railroad Protective Liability Insurance, and a $750 Insurance Surcharge fee.
