Background/Staff Comments

The purpose of Ordinance 2015-58 is, in essence, to correct a mathematical error.

 

This development is known as Southwinds/Oak Meadows Townhouses, located south of Murfreesboro Road and accessed by Oak Meadow Drive. It was originally entitled for 452 multifamily dwelling units (368 apartments and 84 townhomes). The property was first zoned R-3, then PR 11.8 (when PUD zoning was adopted in 1986), then RX (by reclassification), then SD-R 9.16 (by reclassification).

When this property was rezoned to SD-R 9.16, it was erroneously zoned with a density entitlement that was based on dwelling units constructed and not on dwelling units originally approved.

The purpose of this rezoning is to remove 5.19 acres, requesting a rezoning to RM-20 (COF #5946) and to correct the SD-R zoning and density entitlement on the remaining 33.31 acres.

The purpose for rezoning the 5.19-acre parcel will be to provide for the entitlement of the 100 as-yet-unbuilt dwelling units.

 

The rezoning of the remaining 33.31 acres of parcels will calculate the existing, built-out density. The proposed zoning will be SD-R 10.6. (352 existing units/33.31 acres)

 

The owners of the properties were notified by first class mail that this proposed rezoning city would be considered for approval by the Board of Mayor and Aldermen.

PROCEDURAL REQUIREMENTS:

 

1.                     Fifteen half-size copies of the rezoning request shall be submitted to the Department of Planning and Sustainability by 9 am on the Monday after the Planning Commission meeting in order to be placed on the Board of Mayor and Aldermen agenda.

2.                     The city’s project identification number shall be included on all correspondence with any city department relative to this project.
