Purpose
The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning Resolution 2018-50 to award COF Contract No. 2018-0038 to the Joint Venture between M.A.Y. Construction Company, Inc. and Tennessee Valley Paving Co., Inc.
Background
The On-Call Annual Contract for Concrete Work may be utilized by any City department for the maintenance, modification, or construction of City infrastructure that utilizes concrete as its primary component (i.e. curb & gutter, sidewalk/trail, foundations, walls, etc.) In previous years, this particular contract was known as the On-Call Annual Contract for Concrete Curb and Sidewalk Repairs, and was used exclusively for the maintenance by the Streets Department. The reformatting of this contract and its authorizing resolution will all City departments to utilize this annual contract if needed.
On May 11, 2018, the City received sealed bids for this contract. Upon initial review, the apparent low bidder appeared to be Pavement Restoration, Inc. (PRI) with a bid price of $655,500.00. A more thorough review revealed that the apparent low bidder could not honor the unit price, as bid, for one of the larger item contained within the bid. Unfortunately, an error in the listed bid quantity indirectly led the low bidder to make an incorrect assumption when developing his bid price. However, the second, apparent low bidder, a Joint Venture between M.A.Y. Construction Company, Inc. and Tennessee Valley Co., Inc. bid the contract appropriately with the information provided. The bid price submitted by this joint venture was $1,126,550.00. The price bid for concrete curb ramps represents 87% of the difference between the two (2) bidders. Therefore, staff recommends award of this contract to the second lowest bidder, a Joint Venture between M.A.Y. Construction Company, Inc. and Tennessee Valley Paving Co., Inc.
Financial Impact
Resolution 2018-50 and Contract No. 2018-0038 do not directly authorize any funding. Actual funding is approved by the BOMA as either a part of the Annual Operating Budget or via a separate resolution or ordinance.
