Purpose
The purpose of this memorandum is to provide the Board of Mayor and Aldermen (BOMA) with information to consider an appropriation of funds to Franklin First United Methodist Church for improvements made at the intersection of Mack Hatcher and Aldersgate Way.
 
Background
Resolution 2010-40, A Resolution Approving a Concept Plan for Franklin First United Methodist Church, Totaling 106.15 Acres Located at 111 Daniel McMahon Lane, was unanimously approved by the BOMA at the July 27, 2010 Board of Mayor and Aldermen Meeting.  As part of their development, the developer (Franklin First United Methodist Church) was required to complete the following improvements:
1)      Signal Design and Intersection Improvements at Mack Hatcher Parkway and Aldersgate Way
2)      Aldersgate Way Design and Construction
3)      8' Wide Multiuse Trail and Pedestrian Bridge Construction
4)      Public Access Easement Serving City of Franklin Property
 
Below is a summary of the improvements and estimated cost from the developer:
 
Signal Design and Intersection Improvements at Mack Hatcher Parkway and Aldersgate Way
The Department Review Team required the developer to upgrade the existing signal at Mack Hatcher and Spencer Creek Road to provide a 2nd access to their property.  In addition, the developer is to make grading, drainage and pavement modifications to the median on Mack Hatcher to install two left turn storage bays.  Below is a summary of the cost associated with these improvements:

Aldersgate Way Design, Right-of-Way Dedication and Construction
The Department Review Team required the developer to construct Aldersgate Way as a public roadway to provide a 2nd access to the Franklin First United Methodist Church property and allow the City to have access to its property located directly to the west.  Below is a summary of the cost associated with these improvements:

8' Wide Multiuse Trail and Pedestrian Bridge Construction Cost (Approximately 1,310 LF)
The Departmental Review Team required the developer to construct a multiuse trail and pedestrian bridge from the Mack Hatcher trail to the southern property line.  This trail is currently shown on the Franklin Greenway and Open Space Master Plan.  Below is a summary of the cost associated with these improvements:

Public Access Easement and Access Road Improvements Serving City of Franklin Property
The Departmental Review Team required the developer to construct an access roadway from Aldersgate Way to the City-owned property to the West.  Below is a summary of the cost associated with these improvements:  
 
$14,550.00      Construction of Access Drive
 
The rights-of-way dedications are for local streets and do not qualify for Road Impact Fee Offsets since they are not for an arterial street. For the same reason, the greenway path and pedestrian bridge do not qualify for offset of the Road Impact Fees. The roadway/street improvements do not qualify for a Road Impact Fee Offset because they do not add capacity to the arterial roadway, but are for safer, more convenient access to the First United Methodist Church site as well as the adjoining City property.  Since the listed improvements do not qualify for Road Impact Fee Offsets, the City would need to make a contribution to the First United Methodist Church from an alternative funding sources to help offset the cost associated with these improvements should the BOMA so desire to help.  These possible alternative funding sources would include the Hotel/Motel Tax Fund or Facilities Tax Fund for the build-out of the greenway (considered to be a park facility) and Capital Investment Bond proceeds or the City's general fund for the roadway and related expenditures.  
 
It is important to remember that the City worked closely with the First United Methodist Church and the Tennessee Department of Transportation (TDOT) in the relocation of an access right of ingress and egress to access Mack Hatcher Parkway at the approved location of Aldersgate Way as memorialized in COF Contract No. 2014-0184 between the City and TDOT. In order to obtain this right of access at Aldersgate Way, the City agreed to eliminate, or have relocated, its approved right of access to Mack Hatcher Parkway at Daniel McMahon Lane (previously known as Spencer Creek Road). Access to Mack Hatcher Parkway is required by TDOT to be a public street owned and maintained by a public entity (City). During this process of obtaining the relocation of right to access Mack Hatcher Parkway, First United Methodist Church agreed to provide access to the City's property off what is now to be Aldersgate Way.
 
Financial Impact
Franklin First United Methodist Church is making the following request of the Board of Mayor and Aldermen:
 
$162,691.50      50% financial contribution for the Signal Design and Intersection Improvements at Mack Hatcher Parkway and Aldersgate Way.
$  75,847.20      50% financial contribution for the Design, Right-of-Way Dedication and Construction of Aldersgate Way.
$  72,443.00      100% financial contribution for the 8' Wide Multiuse Trail and Pedestrian Bridge Construction Cost
$ 14,550.00      100% financial contribution for the Construction of an Access Drive
$325,531.70      Total Funding Requested
 
Recommendation
Staff recommends approval of Resolution 2015-28 to include only the 8' wide multiuse trail and pedestrian bridge and the construction of the access drive.   Approval of this resolution shall be contingent upon final review and approval by the Law Department and City Administrator.
