Purpose
The purpose of this memorandum is to provide the Board of Mayor and Aldermen (BOMA) information to consider an amendment to Title 21 Chapter 7 of the Municipal Code known as the Inclusionary Housing Ordinance to Previously Approved Planned Unit Developments (PUDs).  The proposed amendment would remove the reference to PUDs approved prior to April 1, 2010 thus making the requirements of this ordinance applicable to any previously approved PUD that is amended to increase density.
 
Background
In the late 2000's the City of Franklin Board of Mayor and Aldermen, Franklin Municipal Planning Commission, and Housing Commission began discussing the importance of implementing a coherent set of policies and objectives to promote housing diversity within our community.  In 2010, the BOMA adopted Ordinance 2010-21 titled Inclusionary Housing for Previously Approved Planned Unit Developments.  This ordinance requires developers seeking additional density to their previously approved PUD to construct housing units in the affordable/workforce housing price range or to contribute funds for the same purpose.  Since adoption, the ordinance has generated over $240,000 in contributions for affordable and workforce priced housing.    
  
A provision included in Ordinance 2010-21 limited the requirements of the ordinance to PUDs approved prior to April 1, 2010.  At the time this ordinance was adopted, the City was experiencing inquiries from developers to modify their previously approved development plans and add density in response of the economic downturn and changing housing trends.  It wasn't anticipated development plans approved after April 2010 would be seeking modifications to add density as well.  The desirability of the Franklin community for new businesses and families coupled with evolving development trends for different housing types has created a housing market that requires developers and communities like Franklin to be open to changing consumer demands.  Therefore, it is recommended that the Board of Mayor and Aldermen continue their support of housing diversity and remove the reference to PUDs approved prior to April 1, 2010 thus making the requirements of this ordinance applicable to all PUDs seeking to add density after the initial approval.
 
Financial Impact
There is minimal staff time needed to implement the requirements of this ordinance during the development review and approval process.  The financial and economic impact associated with not providing housing for our growing workforce requires employees of local businesses to reside outside Franklin which places an additional burden on the resources needed to improve public infrastructure such as adding capacity to roads and creating alternative modes of transportation.

Staff recommends approval of this text amendment.
