Purpose
The purpose of this memo is to provide information to the Franklin Municipal Planning Commission (FMPC) concerning a rezoning for a 30.11 acre property located at the southeast corner of Interstate 65 and McEwen Drive.

Background/Staff Comments
This site is made up of three parcels, and is bordered by I-65 and Huffine’s Ridge Drive to the west and McEwen Drive to the north. The property is currently zoned General Commercial (GC). Currently the Height Overlay District (HTO) is assigned to several properties within immediate vicinity of this site (see provided map). Staff acknowledges that this corner of the intersection has the highest elevation, but is aware that the owner was granted an appeal of a staff decision to prohibit mass grading on its steep slopes. Staff is also confident that any future development of the site will be subject to transitional features in regards to heights. Further, the purpose of the HTO “is to allow for buildings with building heights that exceed 75 feet in specific areas, such as along the Interstate-65 corridor, where such heights create a unique development form but allow for special review to ensure proper fire protection for tall buildings where there may be a high concentration of residents or employees.” Therefore, Staff feels that the location of the site, as well as its proximity to the existing HTO boundary, justifies extending the HTO boundary to this property.

Project Considerations are not conditions of this approval, but are intended to highlight issues that should be considered in the overall site design or may be required when more detailed plans are submitted for review. These items are not meant to be exhaustive and all City requirements and ordinances must be met with each plan submittal.
Traffic Impact Study based on an acceptable Memorandum of Understanding are to be submitted with the development plan. Scope of needed traffic counts has been arranged with Brandon Baxter of RSA.

PROCEDURAL REQUIREMENTS:
1. Fifteen (15) half-size copies of the Rezoning shall be submitted to the Department of Planning and Sustainability by 9am on the Monday after the Planning Commission meeting in order to be placed on the Board of Mayor and Aldermen agenda.
2. The city’s project identification number shall be included on all correspondence with any city department relative to this project.
