Purpose
The purpose of this memo is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning City of Franklin Contract No. 2019-0051, An Agreement Between The City of Franklin and James Jason McConnell and Francesca French McConnell, related to Property located at 1205 Scramblers Knob, Deerfield Section 2 Lot 29 (Map 52 Parcel 49).
Background
A sewer availability request was received October 24, 2018 from the owners at 1205 Scramblers Knob, a property located in Williamson County. The following timeline of events occurred regarding this sewer availability request:
• August 29, 2018 - availability application received for 999 Scramblers Knob
• October 24, 2018 - availability application received for 1205 Scramblers Knob
• CIC October 25, 2018
• Deferred to November for further research by WMD
• CIC November 29, 2018
• Referred to Work Session for discussion
• Resolution 2019-07 presented at Work Session January 8, 2019
• Resolution 2019-07 Approved by BOMA January 22, 2019
The BOMA approved Resolution 2019-07 indicating approval contingent based upon four requirements:
• Property owners desire to annex into the City only when the City deems it appropriate.
• Property owner agrees to participate in any future special assessment district within the Deerfield Subdivision.
• Property owner is responsible for all costs to connect to the public sanitary sewer system.
• The conditions of the Agreement shall be recorded at the Williamson County Register of Deeds.
The attached Agreement and Annexation Agreement are presented based upon these four requirements.
Financial Impact
The agreement allows for a full cost recapture of the City of Franklin Water Management Department installation costs in addition to the payment of all required impact fees.

The attached Agreement was executed on behalf of the Board of Mayor and Aldermen to provide sanitary sewer service to 1205 Scramblers Knob. The conditions in the Agreement, as well as the attached Annexation Agreement, fulfill all contingencies presented in Resolution 2019-07.
