Purpose
The purpose of this memo is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning a proposal from Neel-Schaffer, Inc. to modify their existing Professional Services Agreement (COF Contract 2013-0180) for the 100 Block Battle Avenue Drainage Improvements Project.
Background
On November 26, 2013, the Board of Mayor and Aldermen approved a Professional Services Agreement (COF Contract 2013-0180) with Neel-Schaffer, Inc. for engineering design services, including additional drainage modeling and preparation of contract plans and specifications, on the 100 Block Battle Avenue Drainage Improvements Project.
This Amendment #1 includes an additional fee of $68,200.00 for the following items:
1. Additional land surveying for extended permanent drainage easements totaling $7,500.00;
2. Geotechnical investigations for the proposed detention pond excavation totaling $12,400.00;
3. Significant plan revisions to the 80% complete construction plans and hydrologic model due to issues identified during public meetings and design coordination with affected property owners.

Financial Impact
The original Professional Services Agreement (COF Contract No. 2013-0180) with Neel-Schaffer, Inc. was at a not-to-exceed cost of Sixty-Three Thousand Five Hundred and No/100 Dollars ($63,500.00).
Amendment No. 1 to the Professional Services Agreement (COF Contract No. 2013-0180) with Neel-Schaffer, Inc. is in the amount of Sixty-Eight Thousand Two Hundred and No/100 dollars ($68,200.00). This creates a new not-to-exceed total contract cost of One Hundred Thirty-One Thousand Seven Hundred and No/100 dollars ($131,700.00).
Total project funding included as a part of FY2015 Stormwater Budget under Capital; 89410 Drainage; Various is $1,100,000.00. Staff does not anticipate utilizing a large portion of these funds in the current fiscal year. Therefore, the currently planned FY2016 Stormwater Budget is proposed to include $1,250,000 under Capital; 89410 Drainage; Various.
