Purpose

The purpose of this memorandum is to present Resolution No. 2019-80, a resolution adopting a revised Vendor Protest Procedure for City of Franklin procurements not pertaining to new construction.

 

Background

The City’s Vendor Protest Procedure was last updated on June 27, 2017 by means of Resolution No. 2017-42.  Staff recommends the Vendor Protest Procedure be revised to reflect the protest provision included in Ordinance 2019-24, an ordinance revising Chapter 5 of the Municipal Code of the City of Franklin, entitled Purchasing, to allow for the use of competitive sealed proposals as a procurement method.

 

Resolution No. 2019-80 as proposed, including the revised Vendor Protest Procedure as proposed, is attached. Also attached is a red-lined version of the revised Vendor Protest Procedure as proposed. This red-lined version has marked all recommended changes to the text of the Vendor Protest Procedure.

 

Financial Impact

Staff is not aware of any financial impact of approving the proposed revisions to the City’s Vendor Protest Procedure.

 

Options

As an option to the drafted revisions, the Board of Mayor and Aldermen could choose to direct staff to make alterations to and then re-present the drafted revisions.
