Purpose
The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning the final reimbursement and close-out of the Recovery Agreement for Off-site Sanitary Sewer and Water Improvements for Battle Ground Academy (BGA).
Background
The intent of this resolution is to close out the Recovery Agreement for Off-site Sewer and Water Improvements and reimburse BGA for sewer access fees of $52,500 collected for the last 25 lots in The
Preserve at Echo Estates Section 2 based on the following:
* BOMA Minutes (2/14/1995) showing approval granting BGA the right of recovery of construction costs incurred for the proposed sanitary sewer extension.
* BOMA Minutes (12/14/2004) approving the Recovery Agreement for Off-site Sewer and Water Improvements document.
* The Water Management Department has determined the drainage area that is served by the BGA sanitary sewer extension.
* The Director of Engineering has agreed that all of the construction is complete, and that reimbursement is appropriate.
* The Surety Coordinator has confirmed that no sureties are outstanding.
* Receipts support the construction amount in the agreement.
* Confirmation of Sewer Access Fees collected since the approval date of the document are equal to $152,477.00.
* Confirmation of Sewer Access Fees reimbursed to BGA since the approval date of the document are equal to $99,977.00.
