Purpose
The purpose of this memorandum is to provide information to the Franklin Board of Mayor and Aldermen (BOMA) concerning Contract No. 2018-0100 between the Riverbluff Homeowners Association and City of Franklin Easement Access Agreement to ensure access to the easement, indefinitely.
Background
In 2014, during the Development Plan approval process for the Riverbluff Subdivision, the developer obtained an access and landscape easement from an adjacent property owners, Jerry and Frances Bozeman. This access and landscape easement includes a stormwater drainage swale and these approved improvements are the responsibility of the Riverbluff Homeowners Association to maintain along with other common areas. This agreement, Contract No. 2018-0100 ensures the property owner and Riverbluff Homeowners Association do not abandon or modify the physical limits or conditions of the easement without authorization from the City.
Financial Impact
None. This agreement simply ensures the City of Franklin will have access to this easement, indefinitely, for the purposes of maintaining approved stormwater measures/conveyances in the event the Riverbluff Homeowners fail to maintain them.
Recommendation
Staff recommends approval of Contract No. 2018-0100.
